1. Acceptance of Terms
By accessing or using the SafePlate platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms form a legally binding agreement between you and SafePlate Ltd ("we", "us", "our").
2. Description of Service
SafePlate is a cloud-based food safety management platform that enables food businesses to manage HACCP plans, temperature monitoring, allergen tracking, cleaning schedules, incident reporting, and related compliance activities.
3. Account Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Ensuring that all users within your account comply with these Terms.
- Notifying us immediately of any unauthorised access.
4. Subscriptions and Payment
4.1 Free Trial
New accounts receive a 14-day free trial with full access to the Service. No payment information is required to start a trial.
4.2 Paid Plans
After the trial period, continued use requires an active subscription. Subscription fees are billed in advance on a monthly or annual basis, as selected at the time of purchase.
4.3 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused periods unless required by law.
4.4 Price Changes
We reserve the right to modify pricing with 30 days' notice. Price changes take effect at the start of your next billing cycle.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of food safety regulations.
- Attempt to gain unauthorised access to the Service or its related systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Reproduce, duplicate, copy, sell, or resell any portion of the Service without our written consent.
- Upload malicious code or attempt to compromise the security of the platform.
6. Your Data
6.1 Ownership
You retain full ownership of all data you create, upload, or store on the SafePlate platform ("Your Data"). We do not claim any ownership rights over Your Data.
6.2 Licence
By using the Service, you grant us a limited, non-exclusive licence to host, store, and process Your Data solely for the purpose of providing and improving the Service.
6.3 Data Portability
You may export Your Data at any time through the platform's export features. Upon account closure, we will retain Your Data for 30 days to allow export, after which it will be permanently deleted.
7. Intellectual Property
The SafePlate platform, including its design, code, features, and documentation, is the intellectual property of SafePlate Ltd. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without prior written consent.
8. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind, whether express or implied.
- We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability shall not exceed the subscription fees paid by you in the 12 months preceding the claim.
Important: SafePlate is a management tool and does not replace professional food safety advice or regulatory compliance obligations. You remain solely responsible for ensuring your business complies with all applicable food safety laws and regulations.
9. Termination
We may suspend or terminate your access to the Service if you breach these Terms, with written notice where practicable. Upon termination, your right to use the Service ceases immediately. Sections 6, 7, 8, and 11 survive termination.
10. Changes to the Service
We continuously improve the Service and may add, modify, or discontinue features at any time. We will provide reasonable notice of material changes that adversely affect your use of the Service.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
